                                                    PAYMENT POLICY

 

This Payment Policy ("Policy") constitutes a legally binding document and forms part of our Website Terms of Use.

 

This Policy is presented and enforced by the legal entity Allright Limited, a company registered under the laws of Cyprus, with the address at 67 Kennedy Avenue, Athienitis Kennedy Park, 4th Floor, Office 401, 1076 Nicosia, Cyprus, company registration number: HE 418328 (hereinafter referred to as "We", "Englishdom", "Company", "our", "us", "our"), which provides Users the opportunity to work with the platform englishdom.com (hereinafter – the Platform).

 

GENERAL PROVISIONS ON SERVICE FEES

The Company strives to ensure clear understanding of the financial relations between Students and Teachers regarding the Services we provide. This policy applies to all payment functions available through the Platform and any associated mobile device application of the Platform.

All payments between Students and Teachers are made exclusively through the Platform. All payments on the Platform are processed in U.S. dollars, euros, or hryvnias. Please note that the amount of the Student Payment or other payments may differ from the amount shown in the User's bank statement due to additional fees or exchange rate differences that may be applied by the User's Bank.

Information about the cost of Teachers' services (Rates) is indicated on the Platform. The User acknowledges that they are familiar with the Rates and special conditions.

 

PAYMENT METHODS AND CURRENCY OF PAYMENTS

Payments are made by any method convenient for the Student from the list specified on the Platform.

Payment processing on the Platform is provided by third-party payment processors, including, but not limited to, Ecommpay, WayForPay, Fondy, PayU.

The Platform may also offer installment payments through third-party partners such as Monobank, PrivatBank, or other similar financial services. By using the installment payment service, you agree to read the terms of service provided by such third-party financial service, as well as the refund rules, which may differ from the terms provided by the Platform.

According to the Offer Agreement between the Company and the Teacher, the Platform guarantees the transfer of the Student Payment to the Teacher equivalent to the services provided.

At the same time, the User acknowledges that we may change our partners-providers of payment services.

The payment for the Teacher's services is made in the Student's Personal Account. The moment of payment is considered to be the receipt of the Student Payment into the Company's account. The Student is limited in receiving services from the teacher until the funds are credited.

The Student is solely responsible for the accuracy of the payments they make.

The Platform has the right to engage third-party partners for the organization and receipt of internet acquiring services. Such Partners must possess the appropriate licenses. All transactions with payment cards are carried out in accordance with the requirements of Visa International, MasterCard, and other payment systems. When transferring information, special security technologies for online card payments must be used, and data processing should be carried out on a secure high-tech server of the processing company.

All fees and charges are paid by the User independently. The cost of the Teacher's services can be changed at any moment. The Platform will inform about such changes by posting information on the Platform or through other communication channels with Users indicated on the Platform.

If 18 months have passed from the date of the Student ceasing to receive services from the Teacher, the unused portion of the Student Payment is considered to be the benefit of the Company and is non-refundable. 

 

REFUNDS

In certain cases, upon the Student's request, a refund of the Student Payment may be made.

Refunds are made in the amount of the Student Payment for which services were not provided by the Teacher, without consideration of special conditions at the maximum rate for the actually provided Services. Rights to any promotions and/or bonuses are annulled.

In the event of suspicions of abuse, fraud, manipulation, or any other unlawful actions, the Company has the right to refuse a refund.

All fees and charges are paid by the Users independently.

Refunds for a gift certificate are processed as follows:

- Within 14 days after the payment of the Certificate, exclusively the User who purchased it can contact the Company with a request for a refund; beyond this period, the User has no right to a refund;

- An activated Certificate is considered used and is not subject to exchange or refund under any circumstances;

- The Certificate can be gifted only once and only to one Student or another person (entity). In this case, under no circumstances can funds be returned and/or sent if such a Certificate is returned. Such an entity cannot demand a refund for the Certificate under any circumstances.

 

RECALCULATION OF LESSON PRICES

If a User decides to resume their education after a prolonged period of non-use of lessons (120 calendar days from the moment of cessation of use), the Platform has the right to recalculate the price of lessons according to the current Teacher Rates at the time of such resumption.

 

PROVISION OF SERVICES

The Company provides Users with access to digital products created on the basis of the Platform.

The Company facilitates the conclusion of contracts between Users by providing a Platform for requesting, providing, and paying for educational services. Englishdom serves only as a platform and cannot, under any circumstances, be a party to any contracts between teachers and students or be responsible for any other services or materials provided by the Teacher. The Company does not monitor any transactions between students and teachers in any way.

The commencement of the Teacher's services can only occur upon the Student's Payment being processed. A reserved and scheduled lesson on the Platform can be denied if the receipt of the Student's Payment is not confirmed.

The price of each lesson depends on the level of the Teacher conducting the lesson. Up-to-date information about the cost of lessons is available on the Platform. Please note that Rates may be changed without prior notice.

The Company charges Teachers a fee for using our Platform and Services (Platform Commission for Services). The Platform Commission is collected for each lesson conducted by the Teacher, at a rate according to the Service Provision Offer Agreement between the Teacher and the Platform. The Company may change the fee for using the Platform by teachers, and such changes will take effect after publication on the Platform or notification by email.

 

PAYMENT DATA SECURITY CONTROL

The Company does not collect, store, or process Users' personal payment data. The services and payment systems utilized by the Company are licensed by the European Union and/or member states and/or Ukraine for the secure storage and processing of Users' financial personal data. The Company does not have direct access to such data and complies with the laws of Cyprus and the EU regarding personal data.

The processing center protects and processes the User's credit card data according to the PSI DSS 3.0 standard. The transmission of information to the payment gateway occurs using SSL encryption technology. Further transmission of information takes place over secure banking networks that have the highest level of reliability. The payment provider does not transmit the User's card data to the Company or other third parties. The 3D Secure protocol is used for additional authentication of the cardholder.

Personal data provided by the User (name, address, phone, e-mail, credit card number) are confidential and not subject to disclosure. The User's credit card data is transmitted only in encrypted form and is not stored on the company's WEB server. The Secure Sockets Layer cryptographic protocol (SSL certificate) is used to ensure the reliability of payments. This technology uses asymmetric cryptography for authentication of key exchange, symmetric encryption for confidentiality, message authentication codes for integrity, allowing more secure processing of your payments.

The Company does not process personal data of payers provided in connection with payment processing by the processing center.

When making payments through payment services, our platform adheres to the rules of international payment systems VISA and MasterCard, whose logos are placed on our site.

The User agrees that the Company is not responsible for the failure of a third party to adequately protect such information. Payment processing will be governed by the provisions, terms, and privacy policy of third-party payment processors in addition to this policy. 

 

OTHER TERMS

The Company is not a bank or any financial institution, and we do not provide any financial services. Any payments made through the Platform are conducted solely for the purpose of using the Platform's functionalities to facilitate educational services between Teachers and Students. Such payments cannot be made and used for any fraudulent, criminal, or illegal activities.

The Company may offer, modify, or discontinue discounts, special offers, and promotional campaigns for Users in accordance with the terms determined and introduced exclusively by the Company.
